End-User License Agreement ("Agreement")

Please read this End-User License Agreement ("Agreement") carefully before  downloading or using Sale4cast ("Application"). By using the Application, you are agreeing to be bound by the terms and conditions of this Agreement. This Agreement is a legal agreement between you (either an individual or a single entity) and Sale4cast and it governs your use of the Application or infrstructure  made available to you by Sale4cast. If you do not agree to the terms of this Agreement, do not  download or use the Application. Sale4cast grants you permission to use the Application in accordance with the terms contained herein.

Permission to use

Sale4cast is a facility provided on the Internet cloud to permit end users to execute their Customer Relationship Management (CRM)  programs by using their own proprietory or licensed software on the provided platform or by utlisiing the templates offered on this site, modified to suit their specific needs. Consequently,  there is no warranty or guarantee, direct or implied,  provided  either on the provided application software templates or on the infrstructure provided.

The Sale4cast Application has been architected using a number of GPL software packages that are available from various organisations. A list of the software packages used in the architecting of the Application is given in this  APPENDIX . You agree to be bound by the terms of such GPL licensing terms. The permission to use also provides for usage of one or more web based services, that are governed by the terms of any such web service providers.The access to the application is being provided to you on AS-IS basis and carries no warranty or guarantee, direct or implied.

The application embeds work practices, that are the recommendations of  professional consultation services. This consultative effort is the Intellectual Property Right of the developer and is available as suggestions to operate the Application. This Intellectual property may not be transferred, sold, used, sublicensed or sub-permitted to any other party other than the signatory of this agreement or the orgnisation he/she represents..

The services provided by Sale4cast comprise of  consultation services by embodying a number of work practices in some software programs. By express mention, these software programs, packages or modules, by whatever name called,  carry their own commitment of warranty or guarantee. Sale4cast makes no promise or undertaking that such programs, packages or modules are the best suited for performing such tasks.

Trial

It will be assumed that the End-User has satisfied himself adequately that the work practices incorporated in Sale4cast may be used in its current or modified form to serve him or the organisation he represents. Towards this end, the End-User may use the fully functional application for a period not exceeding 30 days.

Damages, Consequential Damages

Sale4cast expressly disclaims liability for any losses, direct or indirect as a consequence of using the work practices outlined within the Application.

Privacy Policy

In the course of configuring the software for use by the user, there is likely to be certain confidential information captured by the system. This information will be stored on the system and guarded  by the security mechanism provided by the respective developers of such systems. Any information directly available to Sale4cast will be protected by the same degree of protection that Sale4cast provides to its own Intellectual Property assets.

Sale4cast undertakes to not divulge any information contained in the website to any other party, unless under order or warrant from any agency appointed by the Government of India. Notwishstanding anything else, Sale4cast will not sell, distribute, award any of their client information to any party other than their own employees, where it will be divulged strictly on a "need to know" basis.

Refunds

Sale4cast will arrange for  resources to service the requirements of the End-User. In view of the same, Sale4cast is unable to refund any payments contracted  for any period less than 3 months. In the event that the End-User wishes to discontinue the use of the Application after 3 months of contracting for it, a refund equal to the prorated contract rate for the unutilised contract period  may be given, based on a request from the End-User stating his desire to terminate the contract and according a reason therefor. The date for discontinuation will be prospective by at least 15 calendar days.

Refunds will be given in cases where there are errors in the numbers of users or corporate identities, caused by inadequate understanding of the licensing terms, mentioned in the Order  or Invoice. The eligibility for such  refund shall be entertained, if such an error is intimated in writing, of the error,   within 7 calendar days of the date of the Invoice.

Sale4cast grants you a revocable, non-exclusive, non-transferable, limited permission to download, install and use the Application solely for your personal, corporate, non-commercial purposes, strictly in accordance with the terms of this Agreement.

Chargeback

Sale4cast accepts payments directly into their banking account. Sale4cast does not accept payment by the following modes:

VISA/MasterCard
American Express
Discover
JCB
Carte Bleu
Diners Club
EloCard
HiperCard
UnionPay

 or any other card related modes that may have an identified history of fraudulent activity, or are potentially subject to online fraudulent activity..

Consequently, Sale4cast will not entertain requests for chargeback. In the event End-User needs to issue a chargeback for any transaction, they may contact Sale4cast with an explanation of the reason for the same. Sale4cast will take the necessary steps to resolvethe same together with the service agency responsible for collection of payment. The End-User will be updated on the progress of such a resolution, as it occurs.

Third-Party Services

The Application may display, include or make available third-party content (including data, information, applications and other products services) or provide links to third-party websites or services ("Third-Party Services").

You acknowledge and agree that Sale4cast shall not be responsible for any Third-Party Services, including their accuracy, completeness, timeliness, validity, copyright compliance, legality, decency, quality or any other aspect thereof. Sale4cast does not assume and shall not have any liability or responsibility to you or any other person or entity for any Third-Party Services.

Third-Party Services and links thereto are provided solely as a convenience to you and you access and use them entirely at your own risk and subject to such third parties' terms and conditions.

Term and Termination

This Agreement shall remain in effect until terminated by you or Sale4cast.

Sale4cast may, in its sole discretion, at any time and for any or no reason, suspend or terminate this Agreement with or without prior notice.

This Agreement will terminate immediately, without prior notice from Sale4cast, in the event that you fail to comply with any provision of this Agreement. You may also terminate this Agreement by deleting the Application and all copies thereof from your mobile device or from your computer.

Upon termination of this Agreement, you shall be unable to use the Application from your mobile device or from your computer.

Termination of this Agreement will not limit any of Sale4cast's rights or remedies at law or in equity in case of breach by you (during the term of this Agreement) of any of your obligations under the present Agreement.

Amendments to this Agreement

Sale4cast reserves the right, at its sole discretion, to modify or replace this Agreement at any time. If a revision is material we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Application after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Application.

Governing Law

The laws of Maharashtra, India, excluding its conflicts of law rules, shall govern this Agreement and your use of the Application. Your use of the Application may also be subject to other local, state, national, or international laws.

Entire Agreement

The Agreement constitutes the entire agreement between you and Sale4cast regarding your use of the Application and supersedes all prior and contemporaneous written or oral agreements between you and Sale4cast. You may be subject to additional terms and conditions that apply when you use or purchase other Sale4cast's services, which Sale4cast will provide to you at the time of such use or purchase.
